WPS 2006 Rate Case

CUB's reply brief (November 11, 2005) addressing the issues of:

The return of the Non-Qualified Decommissioning Trust Funds
Recovery of WPS's costs associated with the Spring 2005 outage and the sale of Kewaunee Nuclear Power Plant
Cost of service and class revenue allocation
Capital structure and return on equity

WEPCO Fuel Ruel Request

On February 7th, 2005, WEPCO asked for a $115 million fuel cost increase. The PSC granted that amount on an interim basis on March 18, 2005 and approved of a total amount of $122.6 million on November 23rd, 2005.

MGE 2006 Rate Case

MGE is seeking a $14.9 million electric increase (5.09%) and a $3 million gas increase (1.37%)

November 3, 2005 - CUB's reply brief urging the PSC to:

Accept MGE fuel rule refund proposal, but not under MGE's conditions.
Accept CUB's position that MGE's statement that it will not seek a 2007 rate case should not immunize it from a lower return on equity.
Lower customer charges for Time of Use rates.

WEPCO 2006 Rate Case

WEPCO is seeking a $144 million electric increase (7%) and an $80 million gas increase (4%).

December 7, 2005 - CUB's reply brief addressing WEPCO's positions on its proposed earnings cap, return on equity, carrying costs on deferrals, and MISO Day 2 costs.

November 28, 2005 - CUB's initial brief urges a reduction in WEPCO's revenue requirement of at least $70 million by arguing for a lower shareholder return on equity (CUB is seeking no higher than 10.5% while WEPCO wants 12.2%) and lower costs for fuel. CUB's brief also opposes WEPCO's proposal for retention of excess profits by shareholders, and argues for the establishment of renewable energy goals.

CUB expert Lee Smith's surrebuttal testimony (November 7, 2005) uncovering flawed utility computer modeling for coal plant operation that should result in reducing WEPCO's revenue requirement by up to $8 million.
